Women’s plastic surgery "rectification" and deformation "Chengdu Zhao Liying" did not take it as they fell into a 3-year "long-distance" rights protection

"Come in like a star, and drive out like a dog!" Ms. Ning used this sentence to describe her experience as an endorsement for the plastic surgery hospital…

In 2017, the celebrity Zhao Liying was on fire, and Ms. Ning was "photographed" by Sichuan Yuehao Medical Aesthetic Hospital, which she said promised to make her "the Zhao Liying of Chengdu." In April of that year, the rhinoplasty surgery ended, but the recovery was not as smooth as expected. Due to the wound infection, a pustule appeared next to the bridge of her left nose, "and once the pustule ruptures, the entire nose will be removed." But all this, the hospital did not mention to her directly.

An anonymous phone call alerted her that after an emergency surgery, Ms Ning’s nose had been saved, but its shape had changed. Ms Ning went to the hospital several times to negotiate, but neither side reached an agreement. As a result, she was forced to quit her photogenic job and start a "long-distance" rights protection for more than three years.

Patient:

Was "favored" by the plastic surgery hospital

To be built as "Chengdu Zhao Liying"

On September 23 this year, Ms. Ning went to the hospital again to negotiate and was forcibly "invited" by the hospital security.

Ning now sees everyone wearing a mask, afraid that others will see her failed nose at a glance. After taking off the mask, the Chengdu Business Daily-Red Star News reporter saw from the front that her nostrils were everted, and from the side, her nose was much higher than ordinary people, compared with the photos before the plastic surgery, there is a certain gap.

Ning told reporters that in April 2017, when she accompanied a friend to Sichuan Yuehao Medical Aesthetic Hospital (hereinafter referred to as: Yuehao Hospital) for consultation, because her appearance was somewhat similar to Zhao Liying, the staff of the hospital’s operation department hoped that she could become the image spokesperson of the hospital, "to make me the Zhao Liying of Chengdu." Ning said that because she had just graduated at the time and could not resist the temptation, she agreed after many persuasions from the hospital.

The surgery was free, and the total cost was 42,600 yuan. "The nightmare began." Ms. Ning told reporters that the surgery was performed on April 17, and when the stitches were removed a week after surgery, her nose showed signs of infection. "When I left the hospital that day, the nurse quietly stopped me and told me to go back to the infusion, take antibiotics, and keep changing to several antibiotics." When Ms. Ning asked why these treatments were not done in the hospital, the nurse responded, "You have been discharged."

Accident:

Pussy after surgery

Nose deformation after removal of prosthesis

After the stitches were removed, a pussy the size of a ring finger appeared next to the bridge of Ms. Ning’s left nose, but after taking antibiotics for a few months, it still did not improve, and the pussy became bigger and bigger.

One day, four months after surgery, Ms. Ning said, she suddenly received an anonymous phone call. "The person on the phone told me that she was a staff member of Yuehao, and she couldn’t stand it on her conscience. She asked me to get the nose prosthesis out."

Then she went to the Sichuan Provincial People’s Hospital, West China Hospital of Sichuan University, and other cosmetic surgery hospitals for consultation, and the reply was "You must take out the prosthesis immediately, otherwise once the pustules rupture, the entire nose will be removed." After listening, Ms. Ning was scared and immediately went to Yuehao Hospital to take out the prosthesis. After the prosthesis was taken out, Ms. Ning found that the shape of her nose had been changed.

Ms. Ning said that because it was taken out too late, the prosthesis had grown together with the cartilage, so during the operation, the original cartilage of her nose was also removed. "Now, my nose bridge, nose head and nasal septum are almost gone, and I have to leave a gap when wearing a mask, otherwise I will feel breathing difficulties."

"If you can detect the infection and take it out immediately, you can restore it to its original state, so that the nose is not deformed and the contracture is serious." Ms. Ning believes that the hospital deliberately concealed the fact that the infection caused her to miss the best time to take it out. She said that as a spokesperson, she went to the hospital to take various image photos and promotional videos seven days a week, four days a week. "No one reminded me or told me that I was infected."

After the incident, Ms. Ning complained to the Jinniu District Health and Family Planning Supervision and Law Enforcement Brigade and the Jinniu District Health Bureau. This year, she officially submitted a complaint to the court and took Yuehao Hospital to court. The case has not yet been decided.

Identification:

Surgical timing is inconsistent in medical records

Terminated by Chengdu Medical Association

Due to the need for an appraisal of the case, previously, when Ms. Ning took the medical records provided by the hospital for appraisal, she was questioned about the authenticity of the medical records, and the appraisal was terminated by the expert group of the Chengdu Medical Association.

Is there really a problem with the medical records? The reporter saw from the medical records provided by Ms. Ning that the operation time, operation blood transfusion time, etc. were all April 17, but in the "Anesthesia Records", the operation time was changed to April 18. At the same time, in the signature of the anesthesiologist, there were also two doctors, Zhu and Kang. Ms. Ning suspected that her medical records had been "tampered with" by the hospital.

While going through the legal process, Ms. Ning also negotiated with the hospital. On October 14, when Ms. Ning went to the hospital to communicate, the hospital expressed the hope that a judicial solution would be taken.

After the surgery failed, Ms. Ning said, she quit her photogenic job. Over the years, she has spent tens of thousands of dollars going back and forth between multiple departments to collect evidence, which is time-consuming and laborious. Ms. Ning hopes that the hospital will take the initiative to take responsibility and come forward to repair the nose.

Hospital response

The compensation amount cannot be negotiated.

I hope patients will take the judicial route

In this regard, Ms. Han, the executive director of Yuehao Hospital, told reporters: "At that time, the hospital wanted to do some cases, so she came to do the surgery without charging a penny, but there was indeed a problem in doing it. We also admit that… But for so many years, we have been solving it for her."

Why are things at an impasse now? Dean Han said that because the gap between the two sides’ demands for compensation is too large, "she asked for compensation 375,000, and we calculated that it is impossible to have that much money."

Regarding Ms. Ning’s question that the medical records had been revised, Director Han said, "This issue will have to wait for the hospital lawyer to go to court to explain, and it is not convenient for us to state it for the time being."

She said that the two sides had been negotiating before that they could find a hospital recognized by both parties in Chengdu to do the repair, and they had almost reached an agreement. Later, due to the cost of the operation, the negotiation could not be finalized. Now, the hospital wants the patient to go through the judicial route.

Law Enforcement Brigade

Not sure if medical records have been tampered with

Will go to the hospital for investigation

Regarding this matter, the staff of the Jinniu District Health and Family Planning Supervision and Law Enforcement Brigade said that they had indeed received a complaint from Ms. Ning. Regarding the suspected tampering of medical records reported by Ms. Ning, the staff said that they were not sure whether the hospital had tampered with medical records for the time being, and they would go to Yuehao Hospital for investigation.

The staff member also said that Ms. Ning’s medical records were in April 2017, when the state implemented the "Basic Standards for Medical Record Writing (Trial) ", and "there were no relevant penalties at that time." On October 1, 2018, the "Regulations on the Prevention and Handling of Medical Disputes" came into effect, and there were clear penalties for irregular medical record writing.

The staff said: "We must have a legal basis for making administrative penalties, and before October 1, 2018, there are no penalties, so we cannot impose penalties." They will also discuss Ms. Ning’s situation, and they will also respond to Ms. Ning’s other questions after investigation. At the same time, they also hope that Ms. Ning can negotiate with the hospital.
